Equipment Rental Agreement

This is the standard Equipment Rental Agreement that applies to every KinkHire booking. At the time of booking, your details are populated into this agreement and you sign it electronically. A copy is emailed to you and to help@kinkhire.com.au.

1. Parties

This Equipment Rental Agreement ("Agreement") is between KinkHire ("the Supplier") and the individual named in the booking ("the Hirer"). The Hirer's name, contact details, and delivery address are recorded against the booking reference issued at confirmation.

2. Equipment and hire period

The Supplier agrees to hire to the Hirer the equipment described in the booking, for the period from the agreed delivery date to the agreed collection date. The number of hire days, daily rate, and setup and removal (establishment) fee are set out in the booking confirmation.

3. Delivery, setup and removal

The Supplier will deliver the equipment to the Hirer's address, set it up in the agreed location, and collect and remove it at the end of the hire period. The Hirer must provide safe, reasonable access for delivery and removal, including accurate doorway dimensions and access details. If access is not as described and delivery or removal cannot be completed safely, additional costs may apply.

4. Fees, deposit, balance and bond

  • Total hire fee = (daily rate × number of hire days) + setup and removal fee.
  • Deposit: charged to the Hirer's card at the time of booking.
  • Balance: charged to the Hirer's card 48 hours before delivery.
  • Security bond: pre-authorised on the Hirer's card at booking and released after safe return of the equipment.
  • All amounts are in Australian dollars.

5. Cancellation and refunds

The Hirer may cancel and receive a full refund where cancellation is made 72 or more hours before the scheduled delivery time, or within 24 hours of making the booking. Outside these windows the deposit is non-refundable. Cancellations within 72 hours of delivery, and no-shows, are not eligible for a refund and the security bond may be charged.

6. Hirer's responsibilities

  • The Hirer is at least 18 years of age and confirms this by signing the Agreement.
  • The Hirer will use the equipment safely, lawfully, and in private, and will follow all safety instructions and briefings provided by the Supplier.
  • The Hirer will not sub-hire, sell, modify, or remove safety labelling from the equipment.
  • The Hirer will keep the equipment in the condition supplied and protect it from loss or damage during the hire period.
  • The Hirer will allow the Supplier access for collection at the agreed time.

7. Safe use and risk

The Hirer acknowledges that use of bondage, suspension, and adult wellness equipment involves inherent risks, including the risk of injury. The Hirer assumes all such risk and agrees to follow the safe-use guidelines provided for the hired equipment, including any on-delivery briefing by the Supplier's team.

8. Damage, loss and the bond

The Hirer is responsible for the equipment from delivery until collection. If the equipment is returned damaged, unreasonably worn, or is not returned, the Supplier may recover the cost of repair or replacement from the pre-authorised security bond and, where the bond is insufficient, pursue the balance from the Hirer. Normal signs of use do not constitute damage. The Supplier will provide an itemised account of any amounts charged against the bond.

9. Cleaning and hygiene

All equipment is professionally cleaned and inspected before each hire. The Hirer agrees to return the equipment in a reasonably clean condition. Equipment returned in a condition requiring specialist cleaning beyond normal use may incur a cleaning charge, recoverable from the bond.

10. Privacy

The Supplier handles the Hirer's personal information in accordance with its Privacy Policy. The Hirer's information is used only to fulfil the booking and meet legal record-keeping obligations, and is treated with complete discretion.

11. Electronic signature and record

The Hirer signs this Agreement electronically at the time of booking, either by typing their name or drawing their signature. The Supplier records the signature method and an audit trail (browser, platform, language, and timestamp). The electronic signature has the same effect as a handwritten signature. A copy of the signed Agreement, populated with the booking details, is emailed to the Hirer and retained by the Supplier.

12. Limitation of liability

To the extent permitted by law, the Supplier's liability under any booking is limited to the amount paid by the Hirer for that booking. The Supplier is not liable for indirect or consequential loss arising from the Hirer's use of the equipment. Nothing in this Agreement limits any non-excludable consumer right the Hirer may have under Australian consumer law.

13. Governing law

This Agreement is governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria. For any question about this Agreement, contact help@kinkhire.com.au. See also our Terms of Service.
